What if Amber Heard Can’t Pay Damages to Depp?

If Amber Heard declares bankruptcy she won’t have to pay Johnny Depp

The Depp-Heard defamation trial was followed by millions worldwide for its 6 duration. The trial included 100 hours of witness testimonies and ended in Depp’s favour.

The jury ordered Heard to pay Depp $10 million in compensatory damages and $5 million in punitive damages while Depp was ordered to pay Amber $2 million in compensatory damages only.

The question on everyone’s mind is will Amber Heard be able to pay the compensatory and punitive damages or not? If she doesn’t pay what could happen? Let’s find out.

Reduced punitive damages

The presiding judge reduced Amber Heard’s punitive damages from $5 million to $350,000 in accordance with Virginia State Law’s cap on punitive damages, which means Heard should pay Depp $10,350,000 but according to her lawyer Amber will not be able to pay as her net worth is just $1.5-2.5 million.

How will Amber Heard pay the owed damages?

  • Debtors’ prison doesn’t exist anymore so Johnny can only pursue other means to collect his money.
  • Depp can collect Amber’s wages from her upcoming movies.
  • He can seize any assets she owns such as her California home and any jewellery, vehicles, and art collections she may have.
  • Depp can also sell Amber’s assets in open auction with the purpose of collecting the debt and if they still don’t collect the owed amount the court’s judgment may be extended for up to 30 years until the money is fully collected.

Amber Heard can file for bankruptcy

A more than likely scenario would be for Heard to file for bankruptcy through which her $10 million debt will be waived but she will still have to pay the $350,000 in punitive damages.

Final resort

Amber’s final resort would be if Depp himself chose not to execute the judgment, and waive his monetary rights.

Will Depp waive his financial rights?

One of Depp’s lawyers indicated that Johnny may waive the monetary damages and settle for being vindicated in front of the whole world.
